BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 5800 block of Highway 153, being on the northwest line of Highway 153 southwest of Gothard Road. Part of lots 1 and 2, Subdivision of Jesse Evans Tract, as shown by plat of record in deed book 806, page 302, R.O.H.C., and part of an unplatted tract. Said parts of lots and unplatted tract form one tract beginning on the northwest line of Highway 153 some 365.38 feet southwest of the intersection of the northwest line of Highway 153 with the southwest line of Gothard Road, thence with Highway 153 southwest some 553 feet, northwest 25 feet, and southwest some 310 feet, thence northwest some 128 feet (deed), or 150 feet (map), thence southwest some 103 feet, thence northwest some 375 feet, thence northeast some 673 feet, thence southeast some 234 feet, thence northeast some 516 feet, thence southeast some 50 feet, thence southwest 200.38 feet, thence southeast some 247.1 feet (deed), or 260 feet (map), to the northwest line of Highway 153, the point of beginning. Said tract being the property described as Tract 1 in deed book 1207, page 457, R.O.H.C., and part of the property described in deed book 3144, page 423, R.O.H.C. Tax Map No. 91P-A-1 and part of 91P-A-7. from R-1 Residential Zone and R-4 Special Zone to C-2 Convenience Commercial District. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. That an erosion-controlling ground cover be provided for the underdeveloped slopes of the property. 2. That the point of ingress and egress be provided as shown on the site plan and approved by the City Traffic Engineer. 3. That a sight-obscuring screen be provided along the west property line in acordance with Article V, Section 1014.5, Subsection C, of the Chattanooga Zoning Ordinance. 4. That the site grading be on a ratio of no more than 2 to 1. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
